Gabe Feldman Talks Brady DeflateGate Settlement Hearing

TRANSCRIPT

WE HAVE GABE FELDMAN
JOINING US, DIRECTOR OF TULANE'S
LAW SCHOOL AND DOES A LOT OF
WORK AT NFL NETWORK.
YOU CAN FOLLOW
HIMá@SPORTSLAWGUY.
IF THERE'S WINNERS AND LOSERS,
GABE, ON A DAILY BASIS IN THE
COURTROOM, HOW WOULD YOU TERM
THE WINNER TODAY?
>> UNSATISFYING ANSWER, THEY
WERE BOTH LOSERS BECAUSE THEY'RE
IN COURT.
SUPERFICIALLY, THE JUDGE ASKED
THE NFL MUCH TOUGHER QUESTIONS,
JUST LIKE LAST WEEK, BUT I
WOULDN'T READ TOO MUCH INTO
THAT, I THINK THAT'S PAR FOR THE
COURSE WHEN YOU HAVE THE LEAGUE
MAKING THE BROAD ARGUMENT THAT
THEY CAN DO ESSENTIALLY WHATEVER
THEY WANT AND THE PLAYERS
ASSOCIATION IS TRYING TO POKE
HOLES IN THE ARGUMENT.
I DON'T KNOW IF THERE'S A TON OF
BIG WINNERS OR LOSERS.
WE KNOW THAT THE JUDGE HAS
ORDERED UNLESS THEY SETTLE, BOTH
SIDES TO REAPPEAR IN COURT WITH
TOM BRADY AND ROGER GOODELL ON
AUGUST 31st.
SO NO SETTLEMENT, THEN THAT'S
THE NEXT TIME THEY'LL BE IN
COURT.
>> THERE WAS A DISPUTE?
WHAT WAS THE NFL PA BRINGING UP
ABOUT WITNESSES?
THEY WERE UPSET THAN CERTAIN
PEOPLE DIDN'T HAVE TO GIVE
TESTIMONY.
>> YEAH, THEIR BIG ARGUMENT, AND
THEY HAVE TO MAKE AN ARGUMENT
LIKE THIS, EVEN THOUGH HE HAS TO
HOLD A FAIR PROCESS, HAS TO HAVE
A FAIR HEARING, AND IT WAS
UNFAIR THAT THE NFL DIDN'T ALLOW
THE PLAYERS ASSOCIATION TO PULL
JEFF PASH HAS A WITNESS.
HE'S A HIGH RANKING EXECUTIVE
AND LAWYER WITH THE NFL.
HE ALSO PUT HIS NAME ON THE
WELLS SUPPORT.
IF HE SOMETHING TO DO WITH THE
REPORT, WE SHOULD ASK THEM
QUESTIONS ABOUT WHAT HE FOUND IN
THE REPORT.
YOU CAN JUST GET ALL YOUR
INFORMATION FROM TED WELLS.
THE PLAYERS ASSOCIATION SAID
THAT'S UNFAIR.
AND SEEMS TO SUGGEST HE WAS
WILLING TO CONSIDER THE ARGUMENT
THAT WAS UNFAIR.
>> EACH AND EVERY DAY, SEEMS
LIKE WE COME UP WITH THE SAME
QUESTION FOR YOU GUYS STUDYING
THIS THING CLOSELY.
>> THE JUDGE SAID THAT HE WOULD
PROBABLY RULE FOR SEPTEMBER 49,
BUT THERE'S NO GUARANTEE OF
THAT.
BEFORE THAT, IF NOT, PROBABLY A
RULING AROUND SEPTEMBER 49.
REMEMBER, EVEN AFTER JUDGE
BERMAN RULES, WHOEVER LOUISS IS
GOING TO BEAT HIM.
AND THAT APPEAL COULD TAKE
MONTHS, IT MIGHT BE UNTIL THIS
SEASON.
>> WHEN'S THE NEXT TIME WE WOULD
SEE THE COMMISSIONER OR TOM
BRADY IN FRONT OF THIS WHOLE
SITUATION?
>> WELL, IT SOUNDS LIKE AT LEAST
IN PUBLIC IT WON'T BE UNTIL
AUGUST 31st.
ALTHOUGH THE JUDGE WILL PUSH
THEM TO HAVE SETTLEMENT TALKS
YESTERDAY THAT WE DIDN'T KNOW
ABOUT UNTIL AFTER THE FACT.
PUBLICLY WE WON'T SEE THEM UNTIL
AUGUST 31st.
>> WELL, IT'S DEFINITELY AN
ONGOING SAGA, 200-SOMETHING DAYS
AND NOT OVER YET.
I APPRECIATE YOU TAKING TIME.
YOU WERE THERE INSIDE THE ROOM
THERE AND FILLING US IN WITH THE
LATEST DETAILS, THANKS FOR
STOPPING BY, GABE.
>> THANKS FOR HAVING ME.
